Guilde line for extension of lease scheme for houses owned by individuals.
1. The scheme is meant for residential lands owned by individuals. It involves-
-It gives ownership to individuals who have occupied the State land for more than 3 years.
-it extends the leases for lands owned by individuals of which have lapsed with an affordable premium
-it legalizes individual lands which have breached the land use rule.
-it streamlines the levy of premium for Selangor citizens regardless of the location of the lands.
2. The objectives of the scheme are-
-It solves the affordability problem of the public in paying up premium
-it gives an alternative for the public to decide the payment scheme according to what they can afford.
-it helps the State to resolve the squatter issue on the State lands.
-it enhances the administration of land in the State
3. Alienation and extension of lease
-alienation is carried out by way of S76 of the National Land Code
-extension of lease is carried out by way of S197 and S76.
S197-involves the surrender of the whole land
S76-involves realienation of the land to the original owners
-when the lease of the land has expired, it becomes State land. Application must be made before the expiry of the lease if you are to continue with the ownership of the land.
4. Conditions for implementation of the scheme
-the scheme is applicable to all application for alienation and extension of lease for all residential lands in Selangor.
-the scheme can be used to apply for conversion and extension of lease which fall under S204B or S197 and S76 of the National Land Code
5. Calculation of Premium:
For alienation- 1/4x1/100xland value x lease period x land area
For extension of lease and change of land use to residential purpose- 1/4 x 1/100 x land value x lease period x land area
For extension of lease with no change in land use- 1/4x1/100 x(lease period-existing lease period) x land value x land area
For extension of lease (where the existing lease has expired)-1/4 x land value x lease period x land area + special premium. Special premium-RM200x no. years lease has expired+(yearly quit rent x no. years occupied)
6. Rate of premium
-applicant can choose the following rates of premium
-One off payment within the specified period with 30% discount
Or
-RM 1,000 special land payment. If the applicant intends to sell the land or charge the land use, he has to pay premium calculated as in para 5..
-the definition of individual land is lands owned by individual or jointly with another by way of share but not with another company ,society or club.
The transfer of ownership by way of beneficiary or grant of probate or transfer for love
Will not affect special land payment.
7. Period of payment
-payment of premium must be made 6 months form the receipt of Borang 5A. No extension of time will be given.
Base on our experience, application procedure Involves:
- Search
- Purchasing Location Plan
- Filling in Application Forms
- certification by Commissioner of oath
- Original Title & relevant documentations together with application forms to be submitted to Land Office
- Liaison and following up with Authority for Site Visit
- Liaison and following up with all relevant departments until the Application is approved and valuation is carried out.
- To obtain Borang 5A for payment of premium.
- Remitting payment and follow up on issuance of new title
政府宣布关于私人房屋业主延长地契的策划:
1.以上政府策划只针对私人房屋业主,内容如下:
- 政府颁发私人业主房屋所有权给非法使用政府土地3年以上者。
- 政府给予私人业主延长地契交付合理的税收.
- 帮助业主合法化去使用私人土地。
- 加速雪兰莪洲政府对当地人民的土地税务征收。
2. 以上策划的目的是:
- 解决群众针对土地税收的费用支付问题。
- 给予群众针对土地税收的费用支付问题一个相对选择性。
- 帮助政府解决非法建设房屋土地使用问题。
-州政府加强对政府的土地使用管理问题。
3. 征地与土地延长
- 根据国家土地法令的第76条例进行申请与当地政府征地。
- 使用土地条例第197和第76条例 进行延长土地地契的申请。
- 土地条例第197条例需要将土地交回给政府。
- 土地条例第76条例涉及政府从新发配给回业主土地。
- 当土地地契的年份期满时,土地归当地政府所拥有。 业主为了保证继续使用土地的权利必须在土地使用期结速前进行土地延长的申请。
4. 完成以上政府策划申请的条件如下:
- 以上土地征用和土地延长的申请针对全雪兰莪州的屋业用地。
- 以上策划可以用国家土地法令的第204B条例,第197和第76条例进行申请。
5. 土地税收的计算标准:
针对政府分配给还土地:25% X 土地估价 X 延长地契年份/100 X 土地面积
针对土地延长与转换土地使用规划变成屋业:25% X 土地估价 X 延长地契年份/100 X 土地面积
针对原有屋业土地延长:25% X 土地估价 X(延长地契年份-现有地契年份)/100 X 土地面积
针对延长地契(土地使用年限过期者): :25% X 土地估价 X 延长地契年份 X 土地面积+额外费用-包括 RM200 X 地契已过期的年份 + ( 每年的地税 X 过期占领使用的年份)
6. 土地税务的计算标准:
业者可选择预付土地税务的计算标准如下:
- 在指定期限内一次性付费享有30%的折扣
- 或者
- 支付马币1,000的特别费用。如果申请者在享用以上付费后想要出售或者改变土地使用用途,要根据以上第5条重新支付土地税务。
以上内容只针对私人业主或者联名的私人产业,不包括公司,社会或俱乐部等。
业主名义的转换给亲人或其他有利益的人将不影响享受以上特别的土地税收费用。
7. 费用付费的时间
土地税收费用必须从接收政府的批文Borang5A日起6个月内支付。如果业主不能再规定时间内支付以上土地税收费用,政府将不会给予延期,
土地延长的申请步奏:
1. 申请政府土地-(针对非法使用政府土地超过3年者)
2. 延长现有土地到99年
3. 现有土地使用权以过期者延长到99年
4. 其他用途的土地申请转换成屋业及延长到99年。
